| Sumario, etc. | RESUMEN:<br/>Con la promulgación en Cuba del Decreto Ley 302 de 16 de octubre de 2012, el cual modificó la Ley 1312,<br/>Ley de Migración, se vislumbran deficiencias en el orden normativo civil con respecto al migrante heredero<br/>o causante, en tanto no existe coherencia entre lo establecido en esta norma y lo previsto en la ley sustantiva<br/>civil en materia sucesoria, ejemplo de ello es la actual regulación del artículo 470 del Código Civil cubano,<br/>el que señala como incapacidad para suceder el abandono definitivo del país; y el artículo 473 apartado<br/>primero de la propia normativa, que consagra que la participación que le hubiese correspondido a aquel<br/>que ha abandonado definitivamente el país, si excediera del monto total de dos años del salario medio<br/>nacional, no acrece a los herederos y se transmite directamente al Estado; además en materia de Derecho<br/>Internacional Privado, cuando ha de determinarse la ley aplicable en temas sucesorios si el causante o<br/>heredero de la sucesión ha migrado, resulta controvertido el punto de conexión ciudadanía que establece el<br/>artículo 15 de la ley sustantiva civil cubana. |
